1. Introduction
These Terms of Use (the "Terms") govern your use of the mobile application "Sudoku" (the "App") provided by Luiven Co., Ltd. ("Luiven", "we", "us", or "our"). By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms.
2. Eligibility
You may use the App only if you have the legal capacity to enter into a binding agreement in your jurisdiction. If you are under the age required to form a contract, you may use the App only with the consent and supervision of a parent or legal guardian.
3. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a mobile device that you own or control, solely for your personal, non-commercial use.
4. Restrictions
You agree not to: • copy, modify, adapt, translate, reverse engineer, decompile, or disassemble the App, except as permitted by law; • rent, lease, sublicense, sell, assign, or otherwise transfer the App or any rights in it to any third party; • interfere with or attempt to interfere with the proper functioning of the App; • use the App for any unlawful, harmful, or abusive purpose.
5. Intellectual Property
All rights, title, and interest in and to the App, including but not limited to its code, design, graphics, user interface, and content (excluding content that is clearly owned by third parties), are owned by Luiven Co., Ltd. or its licensors. You obtain no ownership rights by using the App; you only receive the limited license described above.
6. Game Data and Local Storage
The App may store Sudoku puzzles, solutions, game progress, statistics, settings (including difficulty, theme, and language), and similar data locally on your device. We do not operate a backend server for this App, and we do not store this game data on our own servers. If you delete the App, clear the App data, or change devices, such locally stored data may be permanently lost and cannot be recovered.
7. Third-Party Services
The App may integrate third-party services, such as analytics services, to help us understand usage patterns and improve the App. These third-party services are governed by their own terms and privacy policies. In particular, we use Firebase Analytics to collect anonymized or aggregated usage data for analytics purposes.
8. User Responsibilities
You are responsible for: • maintaining the security of your device; • ensuring that your use of the App complies with applicable laws and regulations; • not attempting to circumvent or disable any security or technical features of the App.
9. Termination
We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe that you have violated these Terms or are using the App in a manner that may cause harm to us, the App, or other users. You may also stop using and uninstall the App at any time. Upon termination, the license granted to you under these Terms will automatically cease.
10. No Warranty
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUIVEN CO., LTD. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify and hold harmless Luiven Co., Ltd. from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the App or your violation of these Terms.
13. Changes to the App and Terms
We may update, modify, or discontinue the App (or any part of it) at any time, with or without notice. We may also update these Terms from time to time. When we do so, we will update the "Last updated" date above. Your continued use of the App after the effective date of the updated Terms constitutes your acceptance of the changes.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Republic of Korea, unless otherwise required by law.
